1. The defendant shall deliver to the plaintiff the second floor 201 (see attached drawings) among the buildings listed in the attached list, and on August 10, 2017.
Reasons
1. On February 9, 2014, the Plaintiff, among buildings listed in the separate sheet, leased 201 to the Defendant a deposit of KRW 3 million, monthly rent of KRW 3,300,000, monthly management expenses, lease period of KRW 14,00, from February 9, 2014 to February 8, 2015, and thereafter the lease contract has been renewed.
On or after August 10, 2017, the Defendant delayed the payment of rent, and the Plaintiff notified the termination of the lease contract on the grounds of rent delay at least two years on September 28, 2017. Accordingly, the lease contract was terminated.
Therefore, the defendant is obligated to deliver the above building 201 to the plaintiff and pay the plaintiff the overdue rent (management fee first) and the unjust enrichment equivalent to the rent.
