A defendant shall be punished by imprisonment for six months.

Punishment of the crime

1. 업무 방해 피고인은 2016. 4. 4. 09:50 경부터 10:20 경까지 천안시 서 북구 B에 있는 피해자 C 운영의 편의점에서 대금을 지불하지 않고 술과 과자를 가지고 나와 위 편의점 앞 테이블에서 술을 마신 후, 위 편의점 안에 다시 들어가 술과 과자를 가지고 나오려 다가 피해자에 의하여 제지 받게 되자, 피해자에게 “ 짱 개새끼 ”라고 욕설을 하면서 편의점 안에 진열되어 있던 사탕 박스를 안과 바깥 바닥에 집어던지고, 입구 앞에 놓여 있던 쓰레기통을 발로 걷어 차 넘어뜨리고, 다른 손님과 행인들에게 욕설을 하여 편의점에 들어오려 던 손님들이 들어오지 못하게 하였다.

Accordingly, the defendant interfered with the victim's convenience store business by force.

2. A violation of the Punishment of Violences, etc. Act (joint assault) was committed by the Defendant, at the time and place specified in paragraph 1, and at the same time and place, obstructing the business of convenience stores, as described in paragraph 1 above, and obstructed the business of convenience stores, on the ground that the Defendant said the Defendant, the victim D (52 years old) who is another customer, was frighting the victim’s face and shoulder at a drinking time, and the Defendant’s flab E was shaking the victim’s flab.

Accordingly, the defendant assaulted the victim jointly with E.

3. 공무집행 방해 피고인은 2016. 4. 4. 10:30 경 제 1 항 기재 장소에서 위 제 1, 2 항 기재와 같이 소란을 피우면서 편의점 영업 업무를 방해하고 E와 공동하여 D을 폭행하던 중, 112 신고를 받고 출동한 천안 서북 경찰서 F 파출소 소속 경위 G으로부터 인적 사항 확인을 요청 받게 되자, 위 G에게 “ 못 줘, 새끼야, 개새끼야, 니 맘대로 해봐, 씹새끼야 ”라고 욕설을 하고, 손으로 위 G의 가슴을 밀치고 멱살을 잡아 흔들고, 위 G에 의하여 공무집행 방해 현행 범인으로 체포되어 순찰차에 승차하는 과정에서 발로 위 G의 가슴과 오른쪽 다리 부위를 걷어찼다...
