위 피고인과 그 남편인 A는 2014. 7. 21.경 피해자의 가게에서 대화하던 중 피해자의 행동에 대하여 평가하는 듯한 취지의 발언을 하였고 이에 위 피고인과 피해자가 다소 격앙된 어조로 대화[“언니가 나한테 그랬쟎아, 이 놈 저 놈 갈아친다구”, “언제 ”, “그 날 나한테 안 그러셨어요 ”, “내가 엊그제, 너무 화가 나서 그랬어”, “내가 어떤 놈을 갈아치든 살 든 열 놈 스무 놈을 갈아치든 그거는 내 인생이야”]를 나누다가 위 피고인의 남편이 피해자의 얼굴을 1회 때렸으며, 피해자는 즉석에서 이를 112에 신고하였다.

2. 범죄사실 피고인 B는 2014. 7 22. 18:00경 천안시 동남구 D 소재 자신의 상점 앞, 상점 앞의 교회 앞 및 그 앞 현금지급기 상자 안 등 공중에 공개된 세 장소에서,"⑴F 여사장이 ‘나는 이 남자 저 남자 갈아치는 여자다’라고 말하였고, ⑵(내) 남편이 F 여사장을 손바닥으로 1회 밀으니 눈 밑의 광대뼈 주위를 벌겋게 화장품으로 칠한 후 112에 신고하여 경찰관에게는 벌건 부분이 맞은 상처라고 말하였다
