1. The defendant
A. The Plaintiff A’s KRW 82,650,00 and the annual rate of KRW 5% from April 3, 2014 to July 17, 2014.
Reasons
1. Basic facts
A. On December 14, 2012, Plaintiff A and the Defendant: (a) when the Plaintiff cultivated and harvested the pot seeds provided by the Defendant on a dry field of 30,00 square meters (which is located in Chungcheongnam-gun, Chungcheongnam-gun); (b) the Defendant purchased 12,500 won per capital reduction (20km) and entered into an agreement between Plaintiff A and the Defendant to receive after deducting the amount of the pot seeds provided by the Defendant (20 km) from the above purchase price; (c) the Plaintiff cultivated the 540 pot seeds provided by the Defendant; (d) the Defendant refused to take over the pot seeds cultivated by Plaintiff A on the ground that the price of capital reduction drops; and (e) the result was discarded without being harvested at the time.
3) The Defendant paid to the Plaintiff A an advance payment for capital reduction of KRW 10 million on December 14, 2012, and KRW 20 million on December 30, 2012. (b) Plaintiff B entered into an agreement with the Defendant on December 14, 2012, under which the Defendant would be entitled to the deduction of KRW 12,50 per capital reduction (20km) provided to the Defendant from the above sales amount (20km). The Plaintiff B supplied Plaintiff B’s argument to the Defendant on December 14, 2012, and supplied KRW 12,50 per capital reduction (20km) upon cultivating and harvesting the decreased seeds provided to the Defendant. The Plaintiff supplied Plaintiff B’s respective evidence of capital reduction to the Defendant on July 25, 2013.
2. Determination as to the cause of claim
A. According to the result of the fact-finding conducted by the Administrator of the Rural Development Administration in the judgment on the Plaintiff A’s claim, it is recognized that the yield for the reduction of capital in the south of the 2013 spring area was 2,655 km per 10a (302.5 square) and it is confirmed that the yield for the reduction of capital cultivated in spring for 2013 by the Plaintiff A as a capital seed provided by the Defendant is the same quantity.
Therefore, the defendant is the plaintiff.
