Defendant shall be punished by a fine of KRW 2,500,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

The defendant is the representative director of the Gangnam-gu Seoul Metropolitan Government Dispute Resolution Co., Ltd., who is a full-time worker and operates film production business using 30 workers.

1. When a worker dies or retires, the employer in violation of the Labor Standards Act shall pay the wages, compensations, and other money or valuables within fourteen days after the cause for such payment occurred;

Nevertheless, the defendant has been employed on October 17, 201 in the above workplace.

On June 15, 2015, wages of 3,480,590 won in May 2015, wages of 1,747,87,870 won in June, and year-end settlement refund of 202,730 won in total, 5,431,190 won in June 15, 2015 were not paid within 14 days from the date of retirement without any agreement between the parties on the extension of the due date.

2. An employer who violates the Guarantee of Workers' Retirement Benefits Act shall, in case where a worker retires, pay the retirement allowance within fourteen days after the cause for such payment occurred; and

Nevertheless, the Defendant did not pay KRW 13,929,510 of the retirement allowances of retired workers D on June 15, 2015 at the above workplace within 14 days from the date of retirement without agreement between the parties on the extension of the due date.
