피고인은 2016. 3. 초순 일자불상경부터 2016. 8. 18.경까지 서울 동작구 B에 있는 3층 ‘C’ 안에 룸 4개, 여성 대기실 1개, 샤워실 등을 설치하고 ‘D’, ‘E’ 등 인터넷 사이트에 “F”라는 상호로 『A코스 전신마사지(40분) VIP(20분) 8만원, B코스 건식/아로마마사지(60분) VIP(20분) 10만원, 내상NO, 즐달OK!! 손님이 OK! 하시는 마지막 순간까지 정말 최선을 다하겠습니다』라는 문구와 여성들의 신체 중 특정부위를 촬영한 사진을 게재하는 등 업소 광고를 하고 중국인 G, H 등 여성들을 고용하여 대기시킨 다음 인터넷 광고를 보고 찾아온 I 등 남성들로부터 성매매 대금 명목으로 8만 원 내지 10만 원을 교부받은 후 룸으로 안내하고 G 등 여성들로 하여금 I 등 남성들의 성기를 손, 입 등을 이용하여 사정하게 하는 방법으로 유사성교행위를 하게 하였다.
