Punishment of the crime

Around October 1, 2018, the Defendant posted a false letter on the Defendant’s house located in Seocheon-si B, stating that “The sales of clothing, such as the Patom Posing Pospit and the Man-man Round Round,” and that “The Defendant will send the price of the goods first to the victim D who contacted the sales of the goods.”

However, in fact, the defendant did not possess the above goods, and even if he received the goods from the victim, he thought that it will be used for the living expenses of the defendant, and there was no intention or ability to send the goods to the victim.

Nevertheless, the Defendant, by deceiving the victim, received KRW 400,00 from the victim to the F account (G) in the name of E on October 1, 2018 as the price for the goods, and received KRW 400,000 from the victim, and received from the victim the PIN number (H, I, J, and K) of cultural product right amounting to KRW 400,00 in total around October 2, 2018.

1. Around December 24, 2018, the Defendant posted a false statement on the Defendant’s residence located in Seocheon-si B, stating that “I would want to purchase crowdfunding” to the Victim L, who reads “I will send the price of the goods with the right of cultural products first to the customer, if you send the price of the goods to the right of cultural products.”

However, in fact, the defendant did not possess the above goods, and even if he received the goods from the victim, he thought that it will be used for the living expenses of the defendant, and there was no intention or ability to send the goods to the victim.

Nevertheless, the Defendant, by deceiving the victim as above, received cultural product PIN number (M, N,O, P, Q, Q, Q, R, T, U, V, W, and X) equivalent to KRW 400,00,00 in total from the victim around December 24, 2018, and acquired pecuniary benefits equivalent to the same amount after being transmitted to a mobile phone.

2. Around January 9, 2019, the Defendant posted a notice to the victim Y, stating “I wish to purchase a brut (fluort)” at the place specified in paragraph (1) at C.
