1. Basic facts

(1) The following agreements were made by setting the lease deposit amount of KRW 75 million, KRW 500,000 per month for rent (excluding value-added tax), and the lease term from January 4, 201 to January 3, 2016 (hereinafter “A”) as follows: “B” refers to a non-party company; “B” refers to the Plaintiff; and “B” refers to the instant lease agreement.
(2) Article 4 (Rent) (2) Deposit and monthly rent shall not be increased during the term of the contract, and shall be increased by consultation on monthly rent at the time of re-contract after the expiration of the term of the contract. In any of the following cases, this contract may be terminated. (4) In the event of a serious breach of the obligation to perform the contract of “A” or “B”, even during the term of the lease of the preceding two Articles, if “A” or “B” intends to terminate the contract even during the term of the lease of the preceding two Articles, the contract may be terminated by mutual agreement after being notified one month in writing. (2) At the time of the unilateral termination of the contract during the term of the lease, “A” or “B” shall be paid the deposit only if the building of “B” is contracted to a third party. Article 12 (Restoration of Restoration and Termination) of the contract, the Plaintiff shall return the deposit to Nonparty 1, 2, and shall return the deposit immediately after the termination of the lease contract.
