1. The defendant shall be the plaintiff.
A. 12,00,000 won after receipt of each of the documents listed in the separate sheet from the Plaintiff.
Reasons
1. Facts of recognition;
A. On June 2018, the Plaintiff requested Goyang-gu, Gyeonggi-gu to sell a 910 square meters of Gyeonggi-do forest land (hereinafter “land before division”) at KRW 95 million.
Upon introduction of Goyang-gu, the Defendant decided to purchase the land before subdivision in KRW 120 million, and paid Goyang-gu the sum of KRW 50 million on October 22, 2018 and KRW 30 million on October 30, 2018 as the down payment. The Goyang-gu paid KRW 5 million out of the Plaintiff on October 26, 2018, and the remainder KRW 25 million was acquired as the brokerage commission in accordance with the agreement with the Plaintiff.
1. Land before dividing the indication of real estate (275 square meters, 250 square meters) (Partial transfer of 826/910 of shares to be traded);
2. Sales proceeds under Article 2 of the Terms and Conditions of Contract: 120 million won: 30 million won shall be paid and received to the seller at the same time as the contract is concluded. The intermediate payment of KRW 50 million shall be paid and received on November 2, 2018. The balance shall be paid and received on November 2, 2018. The amount of KRW 40 million shall be covered by a special agreement.
Matters of special agreement
1. The seller shall cadastrally divide the seller and register the article jointly owned;
2. On November 2, 2018, when the buyer pays the intermediate payment, the seller shall register the transfer.
3. The seller’s remainder of KRW 20 million (hereinafter “the remainder of KRW 1”) shall be paid to the buyer at the time of completion of construction as sewage pipes to C of the road packing work, and the remainder (hereinafter “the remainder of KRW 2”) shall be paid after completion of the preparation for the application for permission (e.g., land use consent and written consent for road designation consent).
5. Where a seller is indicated as a road in the land category after completion of the road, he/she shall immediately grant a registration of share transfer to a purchaser (the cost of relocation is borne by the
B. On October 25, 2018, the Plaintiff entered into a trade agreement with the Defendant on the following terms (hereinafter “instant trade”).
(The actual date of the instant sales contract is November 2, 2018). A sales contract prepared for the registration of ownership transfer, unlike the instant sales contract, shall be prepared for the registration of ownership transfer.
