1. The defendant's appeal and the plaintiff's incidental appeal are all dismissed.
2. The costs of appeal are assessed against the Defendant and the incidental costs of appeal.
Reasons
The court's explanation of this case is identical to the reasoning of the judgment of the court of first instance, except as follows. Thus, this case is quoted by the main sentence of Article 420 of the Civil Procedure Act.
(The grounds for appeal by the Defendant and the grounds for incidental appeal by the Plaintiff are not significantly different from the allegations in the first instance court, and even if the evidence submitted in the first instance court was presented in the trial, it is justifiable to find facts in the first instance court and make a judgment. On the second instance court, the second instance court deleted “if the trade name is changed to D Co., Ltd., Ltd.,” and added “(if it is divided into D Co., Ltd.)” in the second instance judgment, the second instance court’s “E Co., Ltd.,” in the second instance judgment.
In the third part of the judgment of the first instance, " April 12, 2015" and " April 20, 2015" are " April 12, 2016." and " April 20, 2015." in the third part of the judgment of the first instance, " April 20, 2016."
In the fourth part of the judgment of the first instance, "in accordance with the result of the damage evaluation" shall be added to " January 20, 2017."
Part 8 of the judgment of the first instance court, the "E" in Part 9 is changed to "O, P, Q, which is an employee of the E.
In the 8th judgment of the first instance, the "6% per annum prescribed in the Commercial Act" in the 14th judgment shall be raised to "5% per annum prescribed in the Civil Act".
In conclusion, the plaintiff's claim shall be accepted within the scope of the above recognition, and the remaining claims shall be dismissed as it is without merit. Since the judgment of the court of first instance is justified with this conclusion, the defendant's appeal and the plaintiff's incidental appeal are dismissed as they are without merit. It is so decided as per Disposition.
