Defendant shall be punished by imprisonment for a term of two years and six months and by a fine of ten thousand won.

The defendant does not pay the above fine.

Punishment of the crime

1. Crimes against victims C;

A. On December 2, 2006, the victim C had completed the marriage report with D and gave birth to the victim E, who is a child, and was in a smooth marital life. However, on December 2, 2008, D died due to a disaster, the victim C received KRW 198,708,400 with the death benefit.

그러나 피해자가 베트남 여성이라는 이유로 망 D의 시댁과 사이에 상속 재산을 둘러싸고 다툼이 생겼으며, 이러한 과정에서 한국말에 능숙하지 못한 피해자 C를 위하여 피고인이 상속재산 후견인으로 선임되어, 피해자 C와 시댁 사이를 중재하게 되었다.

From December 30, 2008 to January 13, 2009, the Defendant received KRW 198,708,400 of the network D’s death insurance money from the office of the Glaw Firm in building in the Dong-gu, Dong-gu, Dong-gu, Seoul to keep it in custody for the victim C and the victim E.

While the above death insurance money was kept for the victims, the defendant arbitrarily consumed the total amount of the death insurance money from that time to that time.

Accordingly, the defendant embezzled the victims' property.

나. 사기 피고인은 2012. 2.경 불상지에서, 전화를 통해 피해자 C에게 ‘위 사망보험금 명의를 변경하기 위해서는 변호사를 선임하여 시댁과 합의를 봐야한다, 변호사 비용을 주면 내가 변호사를 선임해주겠다’는 취지로 거짓말하였다.

However, even if the defendant received money from the above victim C, he did not have the intention or ability to appoint a lawyer.

Nevertheless, as above, the Defendant, by deceiving the victim C and deceiving the victim, obtained on February 9, 2012, KRW 380,000,000 from the victim C as attorney-at-law fees, and obtained on May 14, 2012, KRW 5,30,000,000,000 from the victim C, respectively.

C. On December 2008, the Defendant violated the Illegal Check Control Act, which was delivered by C under the name of custody at the “H Care Center” office, and the cashier’s checks, which were issued by C, the check amount of KRW 4,818,00, and check number I.
