The defendant's appeal is dismissed.

1. The gist of the grounds of appeal is as follows: (a) the Defendant cited knife and threatened the victim.

2. According to the evidence duly adopted and examined by the court below, such as the victim D and witness H’s consistent statement in the investigative agency and court, the defendant cited a knife as stated in the judgment of the court below at the time of the instant case and caused the victim to death.

It can be recognized that there was intimidation, and since the statement of the witness to the contrary purport alone is insufficient to reverse the above fact-finding, the above assertion by the defendant cannot be accepted.

3. The defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the grounds that the defendant's appeal is groundless.
