Reasons
Punishment of the crime
The Defendant is a “solicitation” book that purchases stolen or lost smartphones, and C opened a “mull phone” book and puts up a letter on the Internet to purchase smartphones, and if there is a smartphone seller that communicates with the Defendant, the Defendant is a “president” that makes contact with the Defendant to purchase such smartphones, and the Defendant conspireds to purchase smartphones by sharing the above roles with C.
1. At around 15:00 on March 26, 2012, the Defendant: (a) received the order of the said C in the street near the river basin located in Suwon-gu, Suwon-si; (b) purchased 670,000 won in total, with knowledge of the fact that the cost of smartphone 1 is a stolen part of the said C; (c) smartphone 4 (E) smartphone 1 and the victim’s smartphone 4 (F) smartphone 1 and the victim’s smartphone 4 (H. H) smartphone 5:0; and (d) smartphone 5,70,000 won in total, where it is difficult to identify the victim who was stolen from D.
2. At around 16:00 on March 26, 2012, the Defendant received the instructions from the above C in front of the interest ridge street located in Dongdaemun-gu Seoul Metropolitan Government, Dongdaemun-gu, and acquired stolen goods by purchasing at a total of KRW 5.60,00,000 in a gallon road owned by the victim L L, which he stolen from K, one smartphone (M) and one gallon road owned by the victim N, one smartphone (M) and one gallon road owned by the victim P, and one gallon road (ma: Q.).
3. On March 26, 2012, around 15:30, the Defendant received the direction of the said C in the street in the vicinity of the Middle River Station located in Jung-gu, Seoul, China, and acquired stolen goods by purchasing KRW 220,000,00, even though he/she knew that the smartphone 1 cost was a stolen product.
4. At around 17:00 on March 26, 2012, the Defendant received the said C’s instruction in the street near the ordinary waters located in Ansan-gu, Jeondong-dong, and he was from U as above.
