For the reasons indicated in its holding, the lower court upheld the first instance judgment that acquitted the primary charges of this case on the grounds that there is no proof of the crime, and rendered a not guilty verdict on the ancillary charges added by the lower court on the ground that there is no proof of the crime.

In light of the records, the above judgment of the court below is just and it did not err by exceeding the bounds of the principle of free evaluation of evidence against logical and empirical rules, contrary to the allegations in the grounds of appeal.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
