A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On January 29, 2020, the Defendant posted a false statement stating that “The sales of 110,500 won will exceed D 10,500 won at the auction place if the Defendant deposited 110,000 won first.”
However, in fact, the Defendant did not have a game money and did so as to sell it as if it was sold, and it was thought that he would receive money from the victim, so there was no intention or ability to send the game money even if he received money from the victim.
As above, the Defendant, by deceiving the victim, received KRW 110,00 from the F account (G) in the name of the Defendant on the same day, and received KRW 110,00 from that time to February 19, 2020, a total of KRW 196,50 from three victims, such as the list of crimes in attached Form 1.
2. On March 3, 2020, the Defendant sold “game Capital” (K) by linking the Defendant’s dwelling at the Ha and I of the Defendant’s dwelling at the Y and I of the Gyeonggi Suwon-si, the Gyeonggi-si, the Gyeonggi-si, the Gyeonggi-do, and the online GameJ (K).
“A notice to the effect,” and a false statement to the victim L, who reported and contacted, “I will send the game capital if you send the price first.”
However, the defendant did not have the above game capital, so even if he received the price from the victim, he did not have the intention or ability to send it.
Nevertheless, as above, the Defendant, including by deceiving the victim as above, received 44,000 won from the victim to the F account (M) in the name of the Defendant on the same day, from that time, by deceiving the victims by the same method eight times until April 1, 2020, such as the list of crimes in the attached Table 2, and by receiving 421,000 won in total.
