Defendants shall be punished by imprisonment for six months.

However, it is against the Defendants for one year from the date this judgment became final and conclusive.

Punishment of the crime

Defendant

A is a person who has been engaged in livestock products and food sales business under the trade name “D” from January 30, 2015 to March 11, 2015. Defendant B is a person who has been engaged in livestock products, food meat sales and transportation business from May 20, 2014 to January 29, 2015 while operating the said “D”.

1. No one shall indicate or advertise the names, manufacturing methods, ingredients, dietitians, raw materials, uses, quality, and packaging of livestock products, which are different from facts or exaggerated from facts, and shall indicate or advertise contents that are likely to mislead any person to believe that he/she has obtained certification as a safety control certification (HCCP) establishment without obtaining certification;

Nevertheless, from January 30, 2015 to March 11, 2015, the Defendant: (a) supplied livestock products from E, etc. without obtaining the HCCP certification; (b) had been supplied by E, etc., other than HCCP certification companies; (c) as the Defendant had obtained the HCCP certification, attached the HACCP certification mark on both sides of the above “D” to “HACCP product distribution”; (d) falsely marked “HACC-certified factory product distribution” on the right side of the above entrance; (e) supplied the 16 business parties, such as Yong-Nam-nam University, Yong-gu, Daegu-gu, etc., with high pigs, cattle, cattle, and chickens, and the said “D” on which the HCCP-certified certification mark was printed and sold; and (e) indicated “HCCP-certified factory product distribution method” as “Seoul-gu, Daegu-gu, Seoul, and the place for sale of the HCC-gu, Daegu, and indicated “Seoul, Daegu-gu, Seoul.

2. Defendant B

(a) Any person who makes a false representation, such as the HACC certification, shall be different from, or be different from, the name of livestock products, manufacturing method, ingredients, dietitians, raw materials, uses, quality and packaging thereof;
