A defendant shall be punished by imprisonment for four months.
Reasons
Punishment of the crime
1. On September 30, 2008, the Defendant forged private documents: (a) on September 30, 2008, in the column of the location of the real estate lease contract form, which was purchased and prepared in advance at the phrases around the above apartment, the Defendant: “Yansan-si C apartment 1403-104”; (b) on the deposit column, “Yansan-si c apartment 1403-104”; and (c) on the lessor column, the Defendant entered the lessor’s name “K apartment 243 5 Dong-dong 243, 5,” and “L” and “M” in the resident number column, and affixed the seal affixed at his own discretion on the name side.
Accordingly, for the purpose of exercising, the Defendant forged one copy of the real estate lease contract, which is a private document on rights and obligations.
2. On April 16, 2009, the Defendant of fraud and the use of a falsified investigation document is 35,000,000 won of deposit at P office of the Credit Business Chain Co., Ltd., Ltd., operated by the victim PO located in Dong-gu N on April 16, 200, and “Yansan-si, member C apartment 1403-104,000 won of deposit.”
In this paper, I suggested a forged real estate rental contract as stated in paragraph (1) while making false statements.
However, in fact, the Defendant leased and resided the above real estate in KRW 10,00,000 on October 23, 2008 on a monthly deposit of KRW 500,000,000. However, in the above temporary border, there was no deposit remaining due to the loan borrowed money for the above M and the monthly rent of KRW 35,00,000, and there was no fact that the above real estate was entered into a lease contract with the above M.
Around April 16, 2009, the Defendant received 9,500,000 won in cash, excluding advance interest and notarial fees, from the victim’s residence.
Accordingly, the Defendant exercised the real estate lease contract, which is a private document forged as above, and received property by deceiving the victim.
