Punishment of the crime

The defendant of "2014 Highest 674" was a person who operated a aggregate extraction company under the name of another person C(P), D(P), or E(P).

The Defendant was under bad credit standing due to the unpaid amount of national tax of KRW 80 million. Since April 2010, the Defendant was in a large amount of sand put into a market and sold sand collected from the Defendant’s company due to a decline in sand value. However, even if the Defendant borrowed money from another person due to a failure to repay debts of KRW 80 million and KRW 50 million with respect to the said business, the Defendant did not have any intent or ability to pay the money normally even if he borrowed money from another person due to a failure to repay debts of KRW 80 million and KRW 50 million with respect to G.

1. Around September 18, 2010, the Defendant was running a business of collecting aggregate from H that he/she became aware of through his/her son, and the Defendant said that the Defendant would pay a high interest on the loan of the said money because it is difficult to change the funds.

H made a false statement to the victim I stating that “Any person engaged in aggregate extraction business who lends money to him/her,” at a place where it is impossible to know the place on September 18, 2010, H received KRW 30 million from the victim to the (oil) account operated by the Defendant on September 18, 2010, KRW 20 million from the same account around October 1, 201, KRW 25 million from the account under the name of H on October 16, 2010, and KRW 25 million from the account around October 16, 2010.

As a result, the defendant deceivings the victim through H and received a total of KRW 100 million from the victim.
