1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Facts of recognition;
A. The plaintiff is engaged in agricultural product distribution business, such as drilling and math, with the trade name of "C", and the defendant is engaged in warehouse business with the trade name of "D".
E Farming Association (representative F; hereinafter referred to as “E”) purchased and sold May through G as a corporation engaging in agricultural products distribution business like the Plaintiff.
G has been in possession of the deposit passbook in the name of E and has dealt with the purchase and sale of agricultural products in the name of E for not less than 20 years, such as purchase of Maw by using the deposit passbook, and not only E but also E has been requested by other business entities, such as the Plaintiff, etc. to purchase and sell agricultural products.
B. The Plaintiff’s request for the purchase of Mafy to G, etc.) the Plaintiff decided to purchase Jeju Mafy through G. C. G entered into a sales contract with Ansan Agricultural Co., Ltd. under the name of E to enter into a sales contract for an increase of the amount of KRW 250 million for the contract deposit on June 3, 2012 and June 4, 2012. (2) G entered into a sales contract with Ansan Agricultural Co., Ltd. under the name of E to purchase total of KRW 410,692k for an amount of KRW 1,445,635,840 for a total of KRW 1,40,000 in diameter with Ansan Agricultural Co., Ltd. on June 15, 2012. (3) G entered into a sales contract under the name of E to purchase KRW 410,692k for a total of KRW 1,445,635,840 for a total of KRW 50,00 in diameter. However, it appears that E is a corporate clerical error.
