A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. A person who is engaged in driving of a vehicle of c1 ton in violation of the Act on the Aggravated Punishment, etc. of Specific Crimes and the Road Traffic Act (unclaimed Measures after Accidents);
On August 10, 2014, at around 23:10, the Defendant proceeded ahead of the road of the same Dong-dong station located in the upper dong-dong of Ulsan-gu, Ulsan-gu at a speed of 60 km per hour according to two lanes from the upstream of the upper three streets.
At that time, the Defendant stated the victim D indictment as “F” but is a clerical error.
(32) In such a case, a person engaged in driving of a motor vehicle has a duty of care to safely drive the motor vehicle and prevent accidents by securing a necessary distance to avoid a collision with the motor vehicle traveling ahead of it in the same direction.
Nevertheless, under the influence of alcohol, the Defendant, while proceeding as it is while neglecting to do so, was followed by a driver behind the above short circuit passenger vehicle in the same lane.
As a result, the Defendant suffered injury to the said D, such as salt panion, which requires approximately two weeks of medical treatment by occupational negligence as above, and at the same time, the Defendant escaped without immediately stopping a motor vehicle and without taking necessary measures, such as providing relief to the victim, even though it damages the said motor vehicle to be in excess of KRW 2,029,234.
2. Around 23:10 on August 10, 2014, the Defendant driven the poter vehicles described in the foregoing paragraph (1) from the 4km section to the front road of the Gulgju-gun Office, Ulsan-gun, Ulsan-gun, under the influence of alcohol by 0.151% of blood alcohol content.
