Defendant shall be punished by a fine of KRW 5,000,000.

If the defendant does not pay the above fine, 100,000 won shall be one day.

Criminal facts

The facts charged were revised to the extent that it does not infringe on the defendant's substantial right of defense.

The defendant is a person who operates a corporation E with mobile and PC game development and services in Busan Jin-gu D 901 and 902.

On January 2016, the Defendant is entitled to receive subsidies for promotion of employment, if he/she prepares a work contract as if he/she had been employed after completing the employment success program implemented by the Ministry of Labor.

To receive the maximum amount of subsidies for promotion of employment, the monthly wage shall be stated in the employment contract as KRW 1.6 million, but if the monthly wage of KRW 1.46 million is deposited in the head of the Tong, the head of the Tong shall withdraw KRW 7.1 million and request a return again, and F, G, and H shall receive it.

On May 19, 2016, the Defendant filed an application with the Busan Regional Labor Office for the first employment promotion subsidy in 2016, stating that “three newly employed self-denunciations” and “the amount of KRW 6,750,000” and “the ordinary wage of KRW 1,50,000” and submitted each labor contract with F, G, and H.

As above, Defendant submitted an application for subsidies for promotion of the first employment in 2016 and each contract for employment contract, and thereafter, submitted 6,750,000 won from the Ministry of Labor as subsidies for promotion of employment around June 1, 2016, and transferred 6,750,000 won to the national bank account in the name of E Co., Ltd. on or around August 26, 2016.

Accordingly, the Defendant, in collusion with F, G, and H, received a total of KRW 13,500,000 through two occasions, and acquired it by fraud.
