A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

Defendant AD representative director of the corporation AD in Suwon-si AC in Suwon-si, Suwon-si, who runs a construction business using 100 full-time workers.

When an employee retires, an employer shall pay wages, compensations, and other money or valuables within 14 days after the cause for such payment occurred.

Nevertheless, while performing construction works for AF and AG in Pyeongtaek-si AE, the Defendant: (a) as shown in attached Table 1 (1), 2, 3, 4, 5, 10, 11, 13, 14, 16, 18, 19, 31, 37, 54, 59, 64, 16, 11, 12, 13, 16, 17, 23, 27, 36, 40, 47, 50, 58, 60, 64) and (3) (excluding 2), and did not pay wages to employees who retired from his/her service within 14 days from the date of his/her retirement without agreement.

Defendant 1 is an employer who runs construction business by employing 100 full-time workers as the representative director of Suwon-si AC and AD with the second floor of Suwon-si.

When an employee retires, an employer shall pay wages, compensations, and other money or valuables within 14 days after the cause for such payment occurred.

Nevertheless, the Defendant did not pay the wages of the retired workers within 14 days from the date of retirement without the agreement between the parties to the extension of the payment date for the wages of the retired workers, while working in the attached list of crimes (except 8,13, 14, 15, 17, 32, 35, and 36 at the site of the AF, AH, and AI construction work in Pyeongtaek-si AE.

Defendant 1 is an employer who runs the construction business by employing 100 full-time workers as the representative director of AD in Suwon-si AC2 of Suwon-si, Suwon-si.

When an employee retires, an employer shall pay wages, compensations, and other money or valuables within 14 days after the cause for such payment occurred.
