A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
[2017 Highest 2519] On June 10, 2017, the Defendant found the victim E (the age 21) who was in a line with the Defendant and recommended the Defendant to return home in front of the “D” restaurant located in Daejeon-gu Daejeon-dong, Daejeon-gu, Daejeon-gu. On June 10, 2017, the Defendant asked the victim E (the age 21) who was in a line with the Defendant during a meeting at the above restaurant, but the victim refused it, and the victim was able to take a bath, 20 times the face of the victim’s face with drinking and hand, 20 times the victim’s hair while taking a bath, and 13:50 on the same day, the victim’s face was faced with the victim’s face before the house of the said victim, which was parked in the front of the Daejeon-gu, Daejeon-gu, Daejeon-gu, Daejeon-gu, Daejeon-gu, Daejeon-gu, and the victim suffered an excessive part of the victim’s wall.

On June 10, 2017, the Defendant: (a) while under the influence of alcohol at around 08:28, on June 10, 2017, the Defendant driven a vehicle at a distance of about 1km from around 1km to around the “D” restaurant located in Daejeon Seo-gu, Daejeon, Daejeon, without a driver’s license; (b) around 10:20 on the same day, the Defendant driven a vehicle at a distance of about 0.13% alcohol concentration in blood; and (c) on the same day, the Defendant driven the vehicle at a distance of about 1km from around 250m to around 154m in front of the 1695-ro, Daejeon-gu, Daejeon, without obtaining a driver’s license.
2. On June 28, 2017, the Defendant violated the Road Traffic Act (non-licensed driving) around June 28, 2017, without obtaining a driver’s license around 14:55 on June 28, 2017, to the front road of the “GS convenience store” located in the Dong-gu Daejeon-gu Daejeon-gu, Daejeon-gu, without obtaining a driver’s license.
