Punishment of the crime
▣ 범죄전력 피고인은 2014. 11. 10. 서울고등법원 춘천지부에서 마약류관리에관한법률위반(향정)죄 등으로 징역 6년을 선고받고 2019. 10. 18. 군산교도소에서 그 형의 집행을 종료하였다.
▣ 범죄사실 피고인은 마약류취급자가 아니고, 마약류취급자가 아니면 향정신성의약품인 메트암페타민(일명 ‘필로폰’, 이하 ‘필로폰’이라고 함)을 매매하거나 필로폰 매매와 관련된 정보를 타인에게 널리 알려서는 아니 된다.
1. 필로폰 매매 광고 피고인은 2020. 2. 9. 23:24경 강릉시 B건물 C호에 있는 피고인의 집에서, D 사이트에 ‘선샘부터 확인하시고 퀄이 괜찮다고 생각하시면 귀찮아도 0.1부터 거래하시죠 서로 귀찮긴 하지만 먹튀라고 의심은 안가잖아요 ㅎㅎ 믿고 연락주세요 실시간 인증 가능합니다 서울 경기는 빠른 드랍 가능합니다’라는 등의 글을 게재하고, ‘#작대기 #아이스작대기 #빙두’ 등의 해시태그를 사용하는 방법으로 필로폰 매매와 관련된 정보를 타인에게 널리 알렸다.
2. On February 11, 2020, the Defendant promised to notify the police officers belonging to the Busan District Police Agency that he/she reported an advertisement as referred to in paragraph (1) and contacted the Defendant of the fact that he/she sent the amount of opopopopopopopopopopopopopopopopopopopopopopopopopopopopopop from the said police officer, and was transferred KRW 100,000,000 from the said police officer by deposit without a passbook on the same day at around 20:01 and around 20:21 on the same day.
Accordingly, the defendant had the police officer at around 19:10 on the same day, and 0.04 g of philophones in the F of the Geum-gu Busan Metropolitan Government on the same day; 20:30 on the same day, one philophones in the mail located in the same Gu G and approximately 0.04 g of philophones on the same day; 21:30 on the same day, one philophones attached to I in the same Gu H. 0.51 g.
