A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[Criminal Power] On November 19, 2014, the Defendant received a summary order of a fine of one million won as a crime of violating the Road Traffic Act (driving) at the Suwon District Court.

【Criminal Facts】

1. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Bodily Injury resulting from Dangerous Driving) (the Defendant was engaged in driving of BK3 automobiles, and around October 25, 2019, the Defendant transferred 23 intersections from the center to the Sungpo-dong-ro, Ansan-si, Ansan-si to the center.

At the time, since it is night, and at the same time, the driver of a motor vehicle is a private distance intersection, a person engaged in driving the motor vehicle has a duty of care to properly operate the steering gear and brakes of the motor vehicle, and to proceed along the right side of the road at the time of the right-hand.

Nevertheless, the Defendant neglected such duty of care and was negligent in driving in the state of blood alcohol concentration of 0.172%, which is difficult to drive normally due to influence of drinking, and received the Down-hand car of the victim C(23 years old) driving from the direct driving, in front of the right edge of the Defendant’s vehicle.

Ultimately, the Defendant suffered injury to the victim, such as salt, tension, etc. in need of treatment for about two weeks due to the above negligence.

2. The Defendant violated the Road Traffic Act (driving) driving the said vehicle under the influence of alcohol level of 0.172% from the public parking lot of the Guro-gu Seoul Special Metropolitan City Nowon-gu to the same Gu Ansan-ro 100 meters from the day of the same day, under the influence of alcohol level of about 100 meters from the 100-day, Ansan-gu Seoul Special Metropolitan City.

Accordingly, the defendant violated the prohibition of drinking driving more than twice.
