Defendant shall be punished by imprisonment with prison labor for the crimes of 2016 Godan1099, Supreme Court Decision 2016 Godan1748 and Decision 2016 Godan2110.
Reasons
Punishment of the crime
[criminal power] On December 23, 2008, the Defendant was sentenced to 8 months of imprisonment with prison labor for a violation of the Punishment of Violences, etc. Act at the Seoul Central District Court on May 23, 2009, and the judgment became final and conclusive on May 23, 2009 and completed the execution of the sentence at the Seoul Detention Center on September 1, 2009.
[2016 Highest 1099] On June 2008, the Defendant: (a) heard from Da that he was working as an assistant for a member of the National Assembly and that he could transfer to the E University because he was well aware of the supervision of the Eths Association, such as F.I.; (b) the Defendant called “I will transfer to F.I., I will transfer to F.I.,” and called “I will transfer to F.I., I will know that I will transfer to F.I., I will know that I will transfer to F.I., I will know that I will go, I will go, I will go, I will go, I will go well, I will go well, I will go to go to the f., I will go to the f., I will go to the f., I will go to the f., who will go to the f., and will go to the F.I. on August 4, 2008.”
However, the defendant did not have served as an assistant for the National Assembly member, did not know about the supervision of executive officers or F University, such as supervision over the reputation of the President-gu Association, and did not have any intention or ability to transfer victims to F School.
On August 7, 2008, the Defendant, by deceiving the victim as such, transferred KRW 12 million to the Defendant’s national bank account (Account Number G) on August 7, 2008, and transferred KRW 18 million to the Defendant’s national bank account on the 11st day of the same month, and transferred KRW 2 million to the Defendant’s foreign exchange bank account (Account Number: H) on the 22th day of the same month. The Defendant transferred KRW 5 million to the Defendant’s foreign exchange bank account on the 29th day of the same month.
