Reasons
Punishment of the crime
The defendant is the C representative in Gwangju City, who ordinarily employs 15 workers and carries on automobile parts manufacturing business.
"2013 High 465" Defendant did not pay KRW 6,476,593 of D retirement pay and KRW 11,581,515 of E retirement pay, which was worked from April 16, 2009 to July 10, 201 at the same place of business, within 14 days from the date of retirement without any agreement between the parties on extension of the due date for payment of money and valuables.
"2013 Highest 1093" Defendant did not pay 15 million won (monthly salary of 2.5 million won) and retirement allowance of 17,608,696 won within 14 days from his/her retirement without any agreement on extension of the due date for payment of money and valuables between the parties concerned, from August 23, 2005 to November 2, 2012, as an employee F, who worked from May 2012 to October 2, 2012.

1. The Defendant in violation of the Labor Standards Act did not pay the amount of KRW 2 million paid in July 2012 to G workers who worked in the above workplace from January 21, 2010 to October 4, 2012, KRW 2 million paid in August 201, KRW 2 million paid in September 2000, KRW 1.4 million paid in October 19, 201 to October 9, 201, KRW 1.6 million paid in June 201, KRW 200,000 paid in June 20, KRW 200,000 paid in July 200, KRW 1.6 million, and KRW 1.6 million paid in September 1, 201 to each party within 14 days from the date of their retirement without agreement on money and valuables.
2. The Defendant in violation of the Guarantee of Workers' Retirement Benefits Act did not pay the amount of KRW 3,30,643 of the employee I's retirement allowance from October 4, 2010 to October 4, 2012, as well as KRW 5,290,649 of the employee G's retirement allowance, and KRW 3,285,080 of the H's retirement allowance within 14 days from the date of retirement without any agreement between the parties concerned regarding extension of payment deadline for money and valuables.
