Defendant shall be punished by a fine of KRW 8,000,000.

Where the defendant does not pay the above fine, 100,000 won shall be one day.

Punishment of the crime

The Defendant was appointed as a teacher on March 1, 1987 and was assigned to C elementary school located in Daegu on March 1, 2015, and was assigned to the victim D (V, 12 years of age) as a teacher from March 3, 2017 to June 1, 2015.

On May 10, 2017, the Defendant: (a) while getting on board a bus in Daegu to conduct on-site experience in an independent memorial hall located in around 07:15, around 2017; (b) the Defendant wanting to go on the Amphan toilet.

그럼에도 피고인은 같은 날 07:24 경 경북 구미시 E에 있는 F 휴게소에 도착하여, 속옷과 하의가 젖고 남학생들 로부터 똥냄새가 난다는 놀림을 받아 충격을 받은 피해자가 화장실에서 울면서 나오지 않고 있다는 말을 학생들 로부터 들었음에도 피해자의 보호자에게 연락을 하여 피해자의 상황을 알리거나 앞으로 어떻게 할 건지에 대해서 의논하지 않고, 오히려 상황을 알게 된 피해자의 어머니로부터 ‘ 이 상태로 피해 자가 현장체험 학습을 갈 수 있겠느냐,
