The sentence of punishment against the Defendants shall be suspended separately.

Punishment of the crime

1. On November 26, 2014, the K Group of the background of the instant case and the position of the Defendants announced to sell four affiliates affiliated companies of the defense industry including L to M Group, following the withdrawal of the request for formal trial by R. The number of employees belonging to the Changwon Factory was 1,300 against the sales decision, and on December 16, 2014, the number of employees belonging to the Changwon Factory continuously demanded the withdrawal of the sales decision to the company by means of remaining business, peculiar business, and non-regular rejection, strike, internal assembly, etc.

Nevertheless, L, around June 29, 2015, held a general meeting of shareholders in P located in Seongbuk-gu, Seongbuk-gu, Seoul Metropolitan City, in order to change its trade name to Q and decide on the agenda such as the appointment of a new director.

Accordingly, the labor union members belonging to L Subdivision decided to occupy the entrance of the general meeting of shareholders or to interfere with the general meeting of shareholders by participating in the general meeting of shareholders as minority shareholders, and approximately 600 of the labor union members were moved from the window around 00:30 on June 29, 2015 to P by using buses from the window around 00:0 on June 29, 2015, and 05:30 on the same day, all the horse and work clothes were worn to the meeting of the general meeting of shareholders and put together them in P

Defendants and R, as a general staff member of the L branch, had been on board P in accordance with the above resolution of L branch as well as other union members.

2. 범죄사실 피고인들 및 R는 다른 노조원 약 125명과 함께 같은 날 06:00 경부터 같은 날 06:20 경까지 위 P 후문 주차장 앞에서 어깨동무를 하거나 팔짱을 끼고 스크럼을 짜는 방법으로 P 사무총장인 S을 비롯하여 P 직원 및 주식회사 L 주주 등 20 여 명의 출입을 저지하였다.

Accordingly, the defendants interfered with the management of the victim P P's facility and the general meeting of shareholders of the victim L by force.
