A defendant shall be punished by imprisonment for not more than ten months.
except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
"2012 Highest 316" Defendant was operating a number of books against the branch in Gangseo-gu for a period of ten years, and was unable to properly manage the fraternitys, and thereafter, the unpaid amount of the fraternitys that the Defendant did not receive has reached an amount equivalent to 110 million won since September 2007. Since then, the amount of the fraternitys that the Defendant is liable to pay is limited to the amount of KRW 200 million and the amount of the fraternitys that the Defendant received from the fraternitys is required to receive from the financial institution without paying the fraternitys or pay the fraternitys with the amount of the money disposed of the Defendant’s property. Accordingly, there is no intention or ability to pay the fraternitys by operating the normal system even if it is newly organized.
Nevertheless, on July 25, 2008, the Defendant stated to the effect that “E frequency” operated by the Defendant located in Gangnam-si D, the Defendant started to start the number of KRW 20 million in the last number, starting from the payment of KRW 10 million to the victim F, victim G, victim H, and victim I for 27 months each, with the payment of KRW 500,000 per unit of KRW 10,000.”
The Defendant, by deceiving the victims as above, received from the victim F the total sum of KRW 34 million from July 25, 2008 to May 25, 2010, from the victim F, KRW 9.5 million for the same period from the victim G, KRW 23 million for the same period from the victim I, and KRW 1.5 million for the same period from the victim H.
"2012 Highest 452" Defendant was operating a number of books against the branch in Gangseo-gu for 10 years, and was unable to properly manage the fraternitys that did not pay. Since September 2007, the unpaid amount of the fraternitys that the Defendant did not receive was equal to KRW 110,000,000,000, and the amount of the fraternitys that the Defendant is to pay is equivalent to KRW 200,000,000,000,000,000,000 won.
