Defendant shall be punished by a fine of KRW 700,000.
If the defendant fails to pay the above fine, 50,000 won shall be one day.
Reasons
Punishment of the crime
1. On November 18, 2012, around 16:00, the Defendant: (a) acquired a credit card (number: D) on the part of the victim C while purchasing an article; and (b) embezzled the article as he/she had on his/her own think, without following necessary procedures, such as returning it to the victim.
2. Fraud;
A. On November 8, 2012, the Defendant: (a) taken gas station in the Suwon-dong, Busan Metropolitan City, Dongdong-dong 80-5 (State); and (b) paid KRW 31,400,00 to an employee under his/her name, by deceiving his/her employee under his/her name as if he/she were C; and (c) paid it by credit card under paragraph (1), the Defendant received property from the said employee; and (d) caused property damage equivalent to the same amount to the victim so far.
B. On November 18, 2012, the Defendant, at around 18:45, paid KRW 53,130,00 for the purchase of cosmetics at 1406-1 Home Packer, Busan Metropolitan City, Daegu Metropolitan City, and at around 18:45, paid out KRW 53,130,00 for the purchase of cosmetics, by deceiving an employee under his/her name in the same manner as that of paragraph 2(a), received property from the said employee, and thereby, caused property damage equivalent to the same
C. On November 18, 2012, the Defendant, at around 19:28, paid KRW 180,110 for the purchase cost of biological items, etc. at the 1406-1 Home Puss of Busan Metropolitan City, Busan Metropolitan City, 19:28, by deceiving an employee under his/her name in the same manner as that of paragraph 2(a), and the Defendant received the property from the said employee, and thereby, caused property damage equivalent to the same amount to the victim slot Card Co., Ltd.
On November 18, 2012, the Defendant paid 270,90 won for the purchase of children's toy at the Busan Metropolitan City Shipping Daegu Do 1406-1 Home Plus, Busan Metropolitan City on November 18, 2012, by deceiving an employee under his name in the same manner as paragraph 2(a), and by receiving property from the said employee, and to the victim Plus Card Co., Ltd.
