Reasons
Punishment of the crime
The defendant is a person who operates a child care center D in Young-gu Busan Metropolitan City C.
No establisher or operator of a child-care center shall collect child-care fees, other necessary expenses, etc. by fraud or other improper means.
Nevertheless, on March 2014, the Defendant explained to the effect that “the educational expenses for the special activities of the E Music will be paid to the parents of the infants who are the victims of the early child care center,” and that “the educational expenses for the special activities will be used for the infants who are infants, and the education expenses for the special activities would be used for the infants,” and the Defendant made a false statement as if the educational expenses were determined without any violation of the relevant provisions.
However, on March 3, 2014, the Defendant entered into a contract with the representative F of the Busan Busan Branch, Co., Ltd., a company providing infant music programs, in the above childcare center, with the content that the Defendant would pay 10,000 won per infant per infant to the above branch, and in fact, the Defendant agreed to pay a fixed amount of 30,000 won per infant per month, and the difference between the amount paid by calculating 10,000 won per infant per infant and the amount paid by calculating 30,000 won per month by the above branch.
After that, around March 2014, the Defendant received KRW 530,000,000 per person as education expenses for E music special activities from the victims, and received KRW 10,000 from March 2014 to February 2, 2015, in the same way, 12 times the difference from the victims by the same method as indicated in the attached crime list, and received the necessary expenses by fraud or other improper means.
