Defendants shall be punished by imprisonment for six months.

However, each of the above punishments shall be executed for one year from the date this judgment becomes final and conclusive.

Punishment of the crime

Defendant

A is a tree dealer, and Defendant B is a person who has worked as a regular business in F Co., Ltd. (hereinafter “victim”) and Defendant B, as the representative director of the Victim Company, purchased and reselled pine trees owned by the said Victim Company located in Gangwon-do through Defendant B.

Defendant

A around October 2014 through Defendant B, through Defendant B, intended to purchase all the part of the trees owned by the victim company in Gangwon Yangyang-gun H at KRW 70,000,000,000. However, the said G would not sell those trees with KRW 100,000,000.

In other words, there was a lack of negotiations.

Defendant

A around that time, there was a lack of economic situation due to disputes over the land for pine trees that he had developed. Since there was a transaction of pine trees with the above victim company several times, Defendant B requested that Defendant B “I would repay the said pine trees first without the consent of the victim company, and then if the money was later, I would repay the said pine trees later.” Defendant B did not notify the above G of the fact by receiving Defendant A’s request without the consent of the victim company. Defendant B attempted to sell the said pine trees without notifying the said G of the fact.

According to the above conspiracy, Defendant A did not notify the persons related to the above victim company, including G, etc. on November 3, 2014, and applied for confirmation of production of pine trees for 110 weeks owned by the victim company located in the above H. On November 4, 2014, Defendant A did so by 27 pine trees worth KRW 24 million at the market price owned by the victim company, which was planted in the above H around November 4, 2014. Defendant A had 26 pine trees worth KRW 12.2 million at the market price owned by the above victim company by the same method around December 1, 2014.
