피고인은 2013. 9. 17. 08:03경 서울 성북구 B에서 '주취자가 대문을 두드리고 있다'는 112신고를 받고 출동한 피해자인 경찰관 C(남 33세), D(남, 36세)에게 "야, 이개새끼야, 내가 뭘 했다고 너희 다 죽여버릴거야, 씹쌔끼야.", "술 안먹었다, 씹새끼야, 누가 술을 먹어 이개새끼야, 죽여버릴라, 나 깡다구 있다고 개새끼야.", "종암경찰서 이 씹새끼들"이라고 하면서 신고자 및 동네주민 4~5명이 보는 자리에서 욕설을 하여 공연히 피해자들을 모욕하였다.
