A defendant shall be punished by imprisonment for six months.

Punishment of the crime

1. In collusion with persons whose name is unknown, the Defendant: (a) purchased construction machinery by receiving an installment loan from the victim’s Hyundai Myers Co., Ltd.; (b) purchased it as collateral to the bond company immediately; and (c) purchased one construction machinery as a construction machinery skid fishing (D) in that it was affiliated with C around October 29, 2010; (b) purchased 2,6980,000 won from November 20, 201 to October 20, 2013; and (c) concluded a loan agreement with the victim company to borrow 788,000,000 won monthly from November 20, 2010 to October 20, 2013, and paid the construction machinery price with the above loan.

However, even if the defendant purchased the above construction machinery, he did not have an intention or ability to immediately provide the bond company with it as collateral and borrow money, and according to the loan agreement, he did not have an intention or ability to repay the 780,456 won per month to the victim company.

Nevertheless, the defendant deceivings the victim company as above and thereby, he obtained 2,698,00 won from the victim company as a loan.

2. The Defendant: (a) purchased construction machinery described in the above paragraph (1) under the Defendant’s name; (b) created a mortgage on the claim amounting to KRW 27 million with respect to the said construction machinery as mortgagee for the victim Hyundai Social Co., Ltd.; and (c) on November 18, 2010, the said construction machinery was released; and (d) delivered the said construction machinery to, or concealed it by, a bond manager whose name is unknown in the vicinity of the Chungcheong Co., Ltd., Ltd., 849.

Accordingly, the defendant concealed the defendant's goods which were the object of the right of the victim company and obstructed the exercise of the right of the victim company.
