Criminal facts
On February 4, 2014, around 11:00, the Defendant conspiredd to obtain a loan for the purpose of purchasing construction machinery from the victim Hyundai Social Co., Ltd. by taking advantage of the fact that the Defendant had a license for construction machinery pilot and the Defendant was committed as if the Defendant actually used construction machinery in D carbook located in Yeongdeungpo-gu Seoul Metropolitan Government.
1. On February 4, 2014, at a place where it is impossible to identify the place of the Seoul Special Metropolitan City (hereinafter referred to as “Seoul”) around February 4, 2014 in accordance with the above public offering, each of the following items: “E”, “A”, “F”, “F”, and “F” in the publication column: (a) affix the Defendant’s evidentiary photo on the location where the photo is posted; and (b) forged the Defendant’s stamp on the right side under the name of the head of the non-permanent local government; and (c) submitted the forged public document operator’s license as above by facsimile as if the victim’s employee was actually issued the forged public document by means of facsimile as if he/she was actually issued the forged public document operator’s license.
Accordingly, the Defendant, in collusion with the above person without authority, forged one copy of the driver’s license of construction machinery operator under the name of the Defendant, which is an official document without authority, and used forged official document as above.
2. On February 4, 2014, the Defendant paid the principal and interest equivalent to the annual interest rate of 14.9% each month during the 48-month period to G, an employee of the Defendant, who is a non-party affiliated with the victim, an affiliated company in Yeongdeungpo-gu, Seoul, on February 4, 2014, at the office of Mmarket, a non-party affiliated with the victim located in Yeongdeungpo-gu, Seoul, on February 4, 2014 following the said public offering.
