A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
On February 20, 2014, the Defendant concluded that “Around February 20, 2015, the Defendant was a corporation for the purpose of collecting scrap metals and selling steel goods at D offices operated by the Defendant of Kimpo-si, Kimpo-si, and that “A worker of the victim FF corporation operated by E produces bank supplies to be supplied to home shopping, and at the monthly 10 tons of Alumbin scrap (raw scrap scrap) is generated, and the supply of 30 million won is changed.”
However, the fact was that the production or production of the gold-making product was not made properly, and it was thought that it was used only for the purpose of the production of gold with money as a security deposit without the intention or ability to supply the aluminium scrap from the manufacturing process.
As above, the Defendant: (a) by deceiving the employees G of the victim; (b) entered into a contract for the supply of aluminium scrap; and (c) around February 19, 2014, the Defendant transferred KRW 20 million to the account under the name of H company bank managed by the Defendant as the deposit money for aluminium scrap; and (d) around February 20, 2014, KRW 300,000,000,000 from March 3, 2014, to the account under the name of D, respectively; and (b) received KRW 30 million from the victim to the account under the name of D.
around February 11, 2014, the Defendant agreed to provide the scrap metal generated while operating the above factory at the “D” office operated by the Defendant in Kimpo-si, Kimpo-si, Kimpo-si, for two years, and borrowed KRW 20 million from the victim I.
Since then, the defendant was unable to pay money without having agreed to the victim, and the defendant was paid the full amount of the above debt to the victim from the law firm ELS office located in the 13-ro Kim Jong-si around September 30, 2014.
In order to secure the performance of the above obligation, ownership of the article listed in the attached list shall be transferred to the creditor by means of possession and amendment.
