Punishment of the crime

[Criminal Power] On November 13, 2013, the Defendant was sentenced to one year of imprisonment with prison labor for larceny, etc. at the Suwon District Court, which became final and conclusive on February 4, 2014.

【Criminal Facts】

1. On March 17, 2013, the Defendant posted a letter to the effect that he/she sold smartphones by accessing the Internet NAVER C, and reported it to the victim D, thereby making the victim contact, thereby sending the money to the victim.

However, the defendant did not possess as much as selling smartphones, and he thought that he received money from the victim and used it individually, so even if he received the money from the victim, he did not have any intention or ability to sell smartphones.

Nevertheless, the Defendant deceiving the victim as above and transferred KRW 500,000 from the victim to the company bank account (E) in the name of the Defendant on the same day, and continued to receive KRW 50,000 from the victim to the same account.

2. On April 8, 2013, the Defendant made a false statement to the effect that “The Defendant will send the price to the victim upon sending it to the victim upon reporting the fact to the victim F.” by accessing the Internet NAVFC, and selling smartphones.

However, the defendant did not possess as much as selling smartphones, and he thought that he received money from the victim and used it individually, so even if he received the money from the victim, he did not have any intention or ability to sell smartphones.

Nevertheless, the Defendant, by deceiving the victim as above, received 150,000 won from the victim to the above company bank account under the name of smartphone price on the same day.

3. On April 8, 2013, the Defendant: (a) linked to the Internet NAVC, puts up a letter on selling smartphones; and (b) reported and contacted by the Victim G.
