1. The plaintiff (Counterclaim defendant)'s main claim is dismissed.
2. The Plaintiff (Counterclaim Defendant) is Seoul.
Reasons
A principal lawsuit and a counterclaim shall be deemed simultaneously.
1. Facts of recognition;
A. The registration of ownership is completed with respect to the Jongno-gu Seoul Metropolitan Government DD 6.1 square meter (hereinafter “D”) on March 26, 1997 by F on February 19, 197; the registration of ownership made on May 14, 2002 by G on April 8, 2002; the registration of ownership transfer made on March 31, 2003 by H on February 28, 2003; the registration of ownership transfer made on April 24, 2007 by the Plaintiff on April 13, 2007.
B. With respect to the Seoul Jongno-gu Seoul Metropolitan Government E-gi (hereinafter “E”) and its ground buildings (hereinafter “E building”), the registration of ownership transfer made on May 13, 1997 by I on May 13, 197; the registration of ownership transfer made on March 26, 2002 by JJ on March 26, 2002; the registration of ownership transfer made on October 6, 2002 by K on September 6, 2002; the registration of ownership transfer made on December 23, 2013 by L on November 23, 2013; and the registration of ownership transfer made on February 15, 2017 by the Defendant on November 13, 2016.
C. The portion inside a ship connecting each point in sequence 1, 2, 3, 4, and 1 of the annexed drawings of the D land and the portion connected each point in sequence 3, 4, 6, 5, and 3 of the annexed drawings of the E land are facing each other. Of the present D land, the part connected each point in sequence 7, 8, 9, 4, and 7 of the annexed drawings is 0.6 square meters of the area adjacent to the ship (hereinafter “the part adjacent to the ship”) owned by the Defendant, which connects each point in sequence 7, 8, 9, 4, and 7 of the annexed drawings of the attached table No. D land, are 10, 12, 13, 11, and 10 of the annexed drawings, and the part connected each point in sequence 1, 6,000 square meters of the attached drawings of the attached table No. 1, 3,000 square meters of the attached table No. 1,500 square meters of the attached table No.
