A defendant shall be punished by imprisonment for not less than one year and six months.

The defendant pays 150,000 won to the applicant through fraud.

Punishment of the crime

[criminal records] On November 25, 2016, the Defendant was sentenced to imprisonment with prison labor for fraud at the Jung-gu District Court on November 25, 2016 and completed the execution of the sentence at the port prison on December 7, 2017.

[2] On June 18, 2018, the Defendant posted a false advertisement to the effect that he/she connects the Defendant’s residence under the 2018 Gosung C and D to “Sales of Nopt,” by accessing the Internet’s trading site EF, using a portable phone, and false statement to the effect that he/she would send money to the Victim G who reported and contacted the advertisement.

However, the defendant did not have any intention or ability to sell the above Nowon-gu, even if he received money from the damaged party.

Nevertheless, the Defendant: (a) by deceiving the victim and by deceiving the victim as above, acquired 105,00 won via H account (Account Number: I) from the victim on the same day; and (b) obtained a total of KRW 2,184,000 from around that time to August 25, 2018 by means of the same method as in attached Table 1 in the same manner; and (c) obtained a remittance of KRW 2,184,000 on a total of 21 occasions, such as in attached Table 1.

On March 20, 2018, the Defendant made a false statement to the effect that “Around 2018, the 2018 Highest 4127,” the Defendant would deliver to the victim K, who reported and contacted by means of smartphones, one of the sending of the price to the Defendant, by first sending it to the Defendant.”

However, the defendant did not own the above Nowon-do and even if he received money from the injured party, he did not have the intention or ability to deliver the Nowon-do.

As above, the Defendant: (a) by deceiving the victim; and (b) received 300,000 won from the L Bank Account (M) in the name of the Defendant on the same day from the victim; and (c) from that time, from that time, the Defendant
