Reasons
Punishment of the crime
On June 25, 2009, the Defendant was sentenced to eight months of imprisonment for embezzlement in the Suwon District Court’s Ansan Branch, and completed the enforcement of the sentence in the Seoul Southern District Court on February 19, 2010.

1. On December 11, 2012, the Defendant entered “C” and “E” into the column of work place in the column of “D” and the resident registration number column, using C’s personal information acquired at a hospital while working as a guardian at “B Hospital” located in the Seogu-gu, Daegu-gu.
Accordingly, the Defendant forged C’s electronic records on certification of facts with a view to interfering with business affairs related to the issuance of credit cards by foreign banks, etc.
2. On December 19, 2012, the Defendant engaged in fraud, fabrication of private documents, and uttering of the above investigation documents, at the red petroleum station in Daegu, Daegu, on December 12:39, 2012, the Defendant presented the credit card of the foreign exchange bank issued with the name-free employees using the name C as above, as if the Defendant was the legitimate licensee of the above credit card, and signed the sales slip “C” on the sales slip, and then, he was issued to the above employee without knowledge of such fact, and was provided with oil equivalent to KRW 30,000 at the market price from the above owner of the above gas station, which is the victim, from around that time to December 30, 2012, with the intention to sign and use the private document in the name of “C” on a total of 23 occasions, as stated in the attached list of crimes, and exercised the forged document and issued the forged document, and received the goods equivalent to KRW 16,100,510.
3. The Defendant, at around 14:26 December 31, 2012, issued cash automatic withdrawal machines installed at H located in Daegu-gu, Daegu-gu, with the use of the above name C, by a foreign exchange bank credit card.
