1. The defendant shall be located in the area of 203m2 in Gyeonggi-do, Gwangju District Court, Chungcheongnam-gu, Seoul District Court, and the registration office of the Gwangju District Court on April 14, 1995.

1. Basic facts

A. Gyeonggi-do Gwangju-gun District District District Court Decision 615No. 615 (hereinafter “instant land”) was registered in the Land Survey Division on March 10, 1914 as the land survey officer.

B. The Gyeonggi-do Mine-gun Co., Ltd. was integrated with 1915.2.26.E., and the instant land became the Gyeonggi-do Mine-si 203 square meters following the conversion of the area unit and the alteration of administrative jurisdiction.

C. The defendant completed the registration of ownership preservation on April 14, 1995 on the land of this case.

The plaintiff is the heir of G (Death on September 6, 1981) who succeeded to D's property on July 10, 194.

2. Determination as to the cause of action

가. 원고 조부와 사정명의인의 동일성 앞서 든 증거들에 의하여 인정되는 다음의 사정들을 종합하면, 토지조사부에 이 사건 토지의 사정명의인으로 등재된 ‘C에 주소를 둔 ‘D’과 원고의 조부 D은 동일인이라고 추인된다. 1) 원고의 부 망 G은 1919. 3. 24. 광주군 H에서 출생하여, 1944. 7. 10. D의 사망으로 호주상속을 받았는데, D의 딸인 망 G의 매(妹) I 또한 D에 의하여 1924. 3. 9. 광주군 H에서 출생신고 된 점에 비추어 보면, 이 사건 토지에 대한 사정이 이루어질 무렵 원고 조부 D의 주소지는 광주군 H였던 것으로 보인다. 2) 원고 조부 D의 주소지인 광주군 H는 조선말 대한제국 시대 이후로 1915(일본력대정4년).2.26.E와통합되어 F로 되기 전까지는 ‘J'으로 불리기도 한 C 구역에 속하였던 것으로 보인다.
