around 08:30 on April 12, 2018, the Defendant: (a) committed assault against the victim’s D(28) in the domicile of the Defendant of the 1st floor of Sungnam-gu, Sungnam-si; (b) prevented the victim from suffering any defect that the victim intends to move; (c) knife the victim’s KON; (d) knife the victim’s knife; and (e) knife the victim’s knife; and (e) knife the victim’s knife.

Judgment

The facts charged of this case cannot be prosecuted against the clearly expressed will of the victim. According to the records, it is recognized that the victim explicitly expresses his intention not to prosecute the defendant after the prosecution of this case was instituted. Thus, the prosecution of this case is dismissed pursuant to Article 327 subparagraph 6 of the Criminal Procedure Act.
