Defendant A, B, and C, a single-person autopsy team, committed an act of deceiving a victim by misrepresenting an investigative agency, such as the prosecution, to an unspecified number of victims; Defendant A, Defendant B, affiliated with a single-person call center team to which the E (S) and F (S) belongs; and the role of securing another’s account to be used by the check team and receiving money from the said account; Defendant C, upon receiving money from the account holder, intended to take charge of remitting money from the account holder to another account; and Defendant C conspired to block a systematic phishing crime.

A, 피고인 B은 E, F과 함께 2018. 3. 13.경 중국 다롄에 위치한 사무실에서 D에게 전화를 걸어 ‘신용이 좋지 못하다. 대출을 위해서 거래실적을 쌓아야 한다. 거래실적을 만들어 줄테니 당신의 계좌로 돈이 입금되면 현금으로 인출하여 직원에게 전달해 달라.’는 제안을 하여 D로부터 D 명의 I조합 계좌(J)를 제공받아 이를 대검팀에 제공한 후 대검팀에서 D의 계좌를 이용하여 보이스피싱에 사용할 수 있도록 하고, 피고인 C은 콜센터 팀장인 K로 불리는 성명불상자로부터 2018. 3. 15. 10:00경 창원시 성산구 L백화점 앞에서 D를 만나 D로부터 대검팀이 편취한 피해금액을 인출해주면 이를 건네받으라는 지시를 받고 D를 만났다.

대검팀의 성명불상자는 2018. 3. 15. 09:11경 중국 다롄에서 피해자 M에게 전화하여 "서울중앙지방검찰청 검사인데 본인 명의로 대포통장이 개설되었고, 6명의 피해자가 발생했다.
