A defendant shall be punished by imprisonment for six months.

Of the facts charged in the instant case, each of the facts charged shall be acquitted.

Punishment of the crime

The Defendant was sentenced to four months of imprisonment with prison labor at Seoul Southern District Court on June 11, 2009 for the crime of interference with business, etc., and completed the sentence in Seoul Southern District Court on August 22, 2009.

1. On July 17, 2012, at least 08:30 on July 17, 2012, the Defendant: (a) expressed that, under the influence of alcohol, the Defendant “F restaurant in the operation of the Victim D (L, 69 years old)” of Yeongdeungpo-gu Seoul Metropolitan Government, the Defendant: (b) expressed the Defendant’s desire to read “sprinks, sprinks, sprinks, sprinks, spacks. spacks. spacks. spacks. spacks. . . . . . . . . .” to the customers who enter the said restaurant, the Defendant puts the customers on the said restaurant out of the restaurant, and ever 1 hour out of the restaurant and frights from the customers who want to enter the restaurant.”

Ultimately, the Defendant interfered with the victim’s restaurant business by force as above.

2. 피해자 G에 대한 모욕 피고인은 2012. 7. 17. 09:27경 위 ‘F식당’에서, D의 신고로 출동한 경찰관인 피해자 G이 피고인을 제지하자 그곳 손님들 및 주민들 20여명이 듣고 있는 가운데 피해자에게 “내가 죄인이냐. 병신 씹새끼들아. 너네들 얼굴에 침을 뱉고 똥을 싸질러 주겠어. 호로새끼야. 법대로 해라. 씹새끼야. 좆같은 새끼야. 짭새 새끼야. 니 좆은 있냐. 씨발놈아. 너 아구창을 날려 주겠어. 씹새끼야. 너 같은 짭새 씹새끼들은 다 디져야되. 씨발 호로새끼야. 에라 무식한 놈아. 똥보다 더 더러운 놈아. 이 개새끼보다 못한 씹새끼들아”라고 큰 소리로 욕설을 하였다.

Ultimately, the Defendant insultd the victim publicly as above.
