A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On June 19, 2007, the Defendant was sentenced to a fine of one million won for the crime of violation of the Road Traffic Act at the Incheon District Court on June 19, 2007, and a fine of three million won for the same crime from the vice branch of the Incheon District Court on April 9, 2013, respectively.

The Defendant is a person who is engaged in driving a business vehicle B.

On October 11, 2014, the Defendant driven the above vehicle while under the influence of alcohol 0.149% without a driver's license of a motor vehicle on October 11, 2014, and driven the front road of the Ocheon-si C at the Ocheon-si, Ocheon-si from the boundary of the sports complex to the boundary of the Ocheon Police Station at about 40km in speed.

In this case, there was a duty of care to prevent accidents in advance by driving safely according to the traffic signal to a person engaged in driving of a vehicle.

Nevertheless, the Defendant neglected to drive the front stop in a situation where normal driving is difficult due to such influence of drinking, and proceeded as it is, by negligence, in violation of the front stop signal while driving the front stop signal. The Defendant received the front left part of the Defendant’s driving vehicle following the ES3 vehicle driven by the victim D(34 years old) who was waiting in the signal at three-lanes in the same direction, and the part on the right side of the victim F (n, e.g., the 40 years old) who was waiting in the signal at four-lane signal in the same direction.

As a result, the Defendant suffered from each of the above occupational negligence that requires approximately two weeks medical treatment.
