Reasons
Punishment of the crime
1. Defendant A
A. From March 2012 to September 201 of the same year, the Defendant served as an employee of the Victim “J” operated by I in Gyeyang-gu Incheon, Gyeyang-gu.
At around 11:40 on April 7, 2012, the Defendant stolen approximately 38,110,60 smartphones worth a total market value of 36 times from around 2012 to August 29, 2012, by taking advantage of the gaps in the market value of 89,800 won in the store storage, the Defendant used the gaps in the above store, which is the store's store's store's store's store's store's store's store's store's store's store's store's store's store's store's store's market price.
B. At around 15:15 on August 31, 2012, the Defendant attempted to larceny: (a) entered a store warehouse using a crepan in which I’s management was neglected; (b) turned out one LG option 1 unit in the market value of KRW 935,000, and one gallon in the market value of KRW 99,99,90; and (c) was concealed into the gallon’s seat in order to leave; and (d) was committed with a wind that was discovered to K, the said store’s employees.
2. Joint criminal conduct by Defendant B and Defendant C
A. On June 17, 2011, Defendant B was sentenced to ten months of imprisonment by the Seoul Central District Court due to a violation of the Act on the Punishment of Arrangement of Commercial Sex Acts, Etc., and completed the execution of the sentence at the Seoul Detention Center on December 24, 2011.
B. Criminal facts are related to the Defendants, and around March 8, 2012, in the name of Defendant C and in the name of Defendant C, and in the name of purchase of mobile phones via the Internet, etc., the Defendants purchased the main cell phone or lost mobile phone and are engaged in the business of selling the main cell phone.
