A defendant shall be punished by imprisonment for two years.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is a person who operates flower farming in Ulsan-gun, Ulsan-gun, and C is a person who operates E in Gyeonggi-si, and F is a person who operates H in Suwon-si.

1. Around February 2012, the defrauded of subsidies related to the project for the modernization of the flower Production Complex in 2012 refers to “A person who receives subsidies of KRW 21,800,000 equivalent to 50% of the total project cost from the Ulsan-gun Office (hereinafter referred to as the “victim”) in preparation of false documents as if he directly executed the full amount of the cost of automatic ventilation system installation works related to the project for the modernization of the flower Production Complex in 2012,” and C consented thereto.

On June 25, 2012, the Defendant: (a) remitted KRW 21,400,000 to the Agricultural Cooperatives passbook (Account Number I); (b) around June 26, 2012, the Defendant would have executed the full amount of the self-paid charges by receiving KRW 15,00,000 from C; (c) and (d) around June 26, 2012, C entered false details as if the total project cost was equivalent to KRW 49,80,000 in the installation of the automatic ventilation system.

Around that time, the Defendant filed an application for subsidy support with the public official in charge of the Ulsan-si Office located in Ulsan-si, Ulsan-si, 245-2, stating that “The above Corporation completed total project costs of KRW 49,800,000,000, which is 50% double charges, with subsidies,” and submitted a written confirmation of deposits without passbook payments, tax invoices, written estimates, etc. containing false information as evidentiary materials.

Accordingly, the defendant, in collusion with C, had the victim military administration by deceiving it, and had the victim military administration transferred KRW 21,80,000 from the defendant's name to the agricultural bank passbook (Account Number K) around June 29, 2012.

2. On September 2012, the Defendant shall obtain the subsidy related to the project for supporting flowers seeds and seedlings in 2012.
