A defendant shall be punished by imprisonment for not more than ten months and a fine not exceeding 200,000 won.

When the defendant does not pay the above fine.

Punishment of the crime

1. Violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (obscenity using communications media);

A. On August 14, 2019, the Defendant knew that it is possible to send an urgent report call using public machinery mobile phones at B’s residence in Yeongdeungpo-gu Seoul Metropolitan Government on August 14, 2019, and, with a view to meeting his/her sexual desire, calls from the Center for Reporting School Violence 117 School Violence to the Center for 117 School Violence Report of the Seoul National Police Agency, the Defendant leaves the victim C (a person, son) with a view to meeting his/her sexual desire;

In addition, from March 7, 2020 to March 7, 2020, 117 school violence reporting centers reached the words, sounds, which cause sexual humiliation or aversion to female police officers and counselors of the 14th school violence reporting center, such as the attached list of crimes (A-1).

B. On December 23, 2019, the Defendant sent a phone to the 112 comprehensive situation room of the Seoul Regional Police Agency in order to satisfy his/her sexual desire by using a mobile phone from the public machinery at the above place, and then “Isssu tampers as soon as possible” to the victim D (n) who is the police officer, for the purpose of meeting his/her sexual desire using the mobile phone from the public machinery at the above place.

‘The words, etc., which cause sexual humiliation or aversion, have reached a sound.

On March 4, 2020, the Defendant sent telephone to the 112 comprehensive situation room of the Seoul Regional Police Agency for the purpose of meeting his/her sexual desire using a mechanical mobile phone at the above location on March 4, 2020, and caused the victim E (man) who is the police officer to reach the words or sound that may cause a sense of sexual humiliation or aversion by putting his/her speech on the face of visual tear.

2. Violation of the Punishment of Minor Offenses Act;

A. On July 26, 2019, around 21:30 on July 26, 2019, the Defendant sent phone to the Center for Report of School Violence 117 School Violence at the Seoul Regional Police Agency, Seoul National Police Agency (hereinafter “Seoul Regional Police Agency”) with an ambiguous voice, and allowed a counseling private person C (a name, female) to use a false voice, and thus cut off the phone, and received a false report phone for about 10 seconds from July 26, 2019 to March 8, 2020.
