A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

On December 20, 201, at the Daejeon District Court, the Defendant was sentenced to 8 months in prison at night to larceny, etc., and 6 months in prison at the same court on February 21, 2013, and on September 6, 2013, the same court at the same court on September 15, 2015, sentenced 2 years and 4 months in prison due to habitual larceny, etc., and completed the execution of the final sentence in the Daejeon District Court Branch of the Daejeon District Court on October 16, 2016.

1. Around 17:00 on February 15, 2017, the Defendant was well aware of “Del” 202 operated by the victim C in Daejeon Dong-gu, Daejeon, Daejeon, with a copy of one credit card of one bank, one No. 1, one No. 3, and one new bank check, which is the victim’s ownership in the second floor used as his/her residence, when the victim intrudes into the second floor room used as his/her residence.

As a result, the defendant intrudes upon the victim's residence and steals the victim's property and has been sentenced to imprisonment not less than three times, he/she again commits larceny within three years after the execution of the sentence is completed.

2. Violation of Acts in financial business specializing in fraud and credit;

A. On February 15, 2017, the Defendant: (a) purchased at “G” operated by the Victim F in Dong-gu Daejeon-gu, Daejeon; (b) purchased from the injured party one female timbering in an amount equivalent to KRW 700,000 at the market price; (c) made a false representation of the card in the name of her mother as described in paragraph (1); (d) presented it to the victim to pay the amount; and (e) received from the injured party one set of the above set of the card.

B. On February 15, 2017, at around 17:31, 2017, the Defendant purchased one gold booming amounting to KRW 790,000 at the market price from the injured party in the “J” operated by the victim I in the Dong-gu Daejeon-gu Daejeon-gu, Daejeon, and presented the credit card card of one bank, which was stolen as described in paragraph 1, to the victim as her mother’s card and presented it to the victim. The Defendant is the said gold boom from the injured party.
